GAR Contract-to-Close Checklist for Georgia Agents

The documents, dates, and broker compliance items Georgia agents need from binding agreement to the closing table — and how to track them.

Start from the binding agreement date

In Georgia, nearly every contractual deadline runs from the binding agreement date. Get that date right and record it in one place, because due diligence, earnest money delivery, financing, and appraisal periods all count forward from it.

File setup checklist

  • Fully executed purchase and sale agreement with every exhibit and amendment
  • All GAR exhibits triggered by the deal — community association, lead-based paint for pre-1978, FHA or VA loan exhibit, no-financing-contingency exhibit for cash
  • Brokerage engagement agreement or buyer brokerage agreement
  • Agency and brokerage relationship disclosures
  • Seller's property disclosure statement
  • Wire fraud and identity-theft advisories

Dates to calendar immediately

  • Earnest money delivery deadline
  • End of due diligence period
  • Loan application deadline
  • Appraisal contingency expiration
  • Financing contingency expiration
  • Final walkthrough
  • Closing date and possession date

During due diligence

  • Earnest money receipt from the holder — attorney or brokerage
  • Inspection reports and any amendment to address concerns
  • Repair amendment, credit amendment, or price amendment, fully signed
  • Termination notice and earnest money disbursement, if the buyer exits

Under contract to closing

  • Appraisal result and any appraisal-related amendment
  • Loan commitment or clear-to-close confirmation
  • Association documents and closing letter
  • Survey, if ordered
  • Signed ALTA or settlement statement after closing
  • Commission disbursement authorization

Broker compliance

Georgia brokers are responsible for the completeness of the transaction file. Most compliance headaches are not missing signatures — they are missing documents nobody realized were required until the file was audited.

OFFRCTC turns this checklist into a live file for each transaction. Documents pulled from the accepted offer attach themselves to the right checklist item, your broker or a designated reviewer approves or rejects each one with a note, and everyone can see at a glance what is still outstanding.

A note on forms

GAR forms are revised annually. Always use the current-year form for the year the contract is written, and never mix exhibit years within one file. This guide is a workflow reference, not legal advice — consult your broker or attorney for the requirements that apply to your transaction.
